1. Acceptance of Terms
1.1 By using the Aalto Lounge Photo Booth services ("Services"), you agree to comply with and be bound by these terms of service ("Terms"). If you do not agree with these Terms, please refrain from using the Services.
2. Use of the Services
2.1 The Services provided include the use of a photo booth to digitally capture and deliver photos to you via text message and a link to a website hosting the photos.
2.2 Users must be 18 years old to use the photo booth or have the consent of a legal guardian.
2.3 Users are solely responsible for the content of the photos taken using the photo booth.
3. Delivery of Photos
3.1 Upon completion of the photo session, if you opt-in to receive text messages, you will receive a text message containing a link to a website hosting the photos. Message and data rates may apply, depending on your mobile phone service plan.
3.2 The link will be accessible for a period of at least 6 months, after which the photos may be deleted from the hosting website.
4. Privacy and Data Security
4.1 We take the privacy and security of customer data seriously. All personal information collected during the use of the photo booth will be handled in accordance with our Privacy Policy.
4.2 You are advised not to share sensitive personal information in the photos, and we shall not be held liable for any consequences resulting from such sharing.
5. Use of Materials
5.1 All photos taken using the photo booth are the intellectual property of the customer. However, by using the Services, you grant us a non-exclusive, royalty-free license to use, reproduce, and display the photos for promotional purposes related to the Services.
5.2 You agree to indemnify and hold the Services and affiliated companies, and their directors, officers and employees, harmless for any and all claims or demands, including reasonable attorney fees, that arise from or otherwise relate to your use of the Services, any content you supply to the Services, or your violation of these Terms or the rights of another.
6. Code of Conduct
6.1 Users must use the photo booth responsibly and in compliance with applicable laws.
6.2 Users must not engage in any activities that could cause harm, discomfort, or offense to others.
7. Limitation of Liability
7.1 We are not liable for any loss or damage incurred as a result of the use of the photo booth or the hosting website.
7.2 In no event shall we be liable for any indirect, consequential, or incidental damages arising out of or related to the Services.
7.3 In addition to any excuse provided by applicable law, we shall be excused from liability for non-delivery or delay in delivery of the Services arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, adverse weather, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are listed above.
8. Modifications to Terms
8.1 We reserve the right to modify these Terms at any time. Users will be notified of any changes, and continued use of the Services after such modifications constitutes acceptance of the revised Terms.
9. Governing Law
9.1 These Terms shall be governed by and construed in accordance with the laws of the State or Oregon.
